  • Slaughtering house
  • Food or health supplements and nutraceuticals
  • Small retailers dealing in food products 
  • Cottage industries that function as FBOs
  • E-commerce

  • Dairy units including milk cooling units
  • Small shops such as a sweet shop, juice stall, tea shop, green groceries, Dhaba, bakeries, food mart, etc. 

All the above-mentioned food-oriented businesses need Fssai registration/license.

TYPES OF FOOD SAFETY LICENSES

As per the Food Safety and Standards Act, 2016, there are three types of Licenses available for every food-related organization. They are listed below

FSSAI BASIC REGISTRATION

FSSAI BASIC REGISTRATION

FBOs that have a yearly turnover anywhere within Rs.12 lakh are required to apply for a Basic Food Registration. These hold all small-scale operators, which are working from and within a single area, region, city or town have to be registered under FSSAI as Basic FBO. This sort of Basic certificate has to be applied to the State where the business is based.

  • FBO is a wholesaler, distributor, supplier, and retailer, food vending establishments, hawkers, club, canteen, Dhaba, hotel, restaurants, and storage with an annual turnover of less than Rs. 12 lakh.
  • Retailers selling food items with limited operations.
  • Petty producers manufacturing by themselves
  • Cottage industries associated with food products.
  • Dairy units, involved in procurement/collection/handling/chilling of milk, having a capacity of not more than 500 litres per day, or up to 2.5 Metric Ton of milk solids annually.
  • Production or processing units of vegetable oil by the process of solvent extraction and refineries including oil expeller systems. With a capacity to provide not more than 100 kg/litre per day (except milk or meat).

 

FSSAI STATE LICENSE

FSSAI STATE LICENSE

An organization with more than 12 Lakh of turnover and not exceeding 20 crores needs to apply for the state license. It is regulated and provided by the authorities of the State Government. It provides recognition to the company and provides credibility among the consumer. The validity of a state license is a minimum of one year to a maximum of five years.

The organization is eligible for the state license

  • Turnover above 12 lakhs
  • Proprietary food such as energy drinks, flavoured and coloured food
  • Hotels with 4-star rating 
  • All food processing units including re-packers, with a daily capacity of not organization kg/litre to up to 2 metric tonnes.

FSSAI CENTRAL LICENSE

FSSAI CENTRAL LICENSE

The company which yields more than 20 crores of turnover are required to apply for the central license. This central license was regulated and provided by the Central Government. The manufacturers or sellers who export their products to multiple states can obtain this license. It provides legal permission to export food products.

The organization is eligible for the state license

  • FBOs like restaurants, retailers, distributors, and suppliers with an annual turnover of more than Rs. 20 crores.
  • Exporters and importers of food products 
  • The FBOs having more than one branch of restaurants or food joints are required to apply for a Central Food License.
  • FBOs operating in 2 or more states have to apply for one Central License for its Registered Head Office 
  • Manufacturing and processing units of vegetable oil by the method of solvent extraction and factories including an oil expeller unit, with a capacity of over 2 metric tonnes per day.
  • 5-star hotels
  • Storages with a capacity of more than 50,000 metric tonnes
  • All food processing units including re-packers and excluding the grains, pulses & cereals milling units with a capacity of over 2 metric tonnes per day.

The required documents may differ, depending on the object, capita, turnover, etc.

Basic required documents for registration:

  • Photo of the applicant
  • Photo Ids issued by the government such as Aadhar, PAN, Voter id etc.
  • Address proof of the business activity

Documents required for manufacturing business:

  • List of directors or partners or proprietor with basic details
  • ID and address proof of the directors or partners or proprietor
  • Partnership deed or self-declaration for proprietors
  • MOA and AOA
  • Xerox of certificate obtained under coop act, 1861 or multi-state coop act-2002 in case of cooperatives
  • Form IX (not needed for proprietor)
  • Blue print 
  • Photo of the production unit 
  • List of the equipment with the name of the equipments
  • Analysis report
  • NOC from the municipal corporation or local authority
  • IEC document provided by DGET

Documents required for non-manufacturing business:

  • List of directors or partners or proprietor with basic details
  • ID and address proof of the directors or partners or proprietor
  • Partnership deed or self-declaration for proprietors
  • MOA and AOA
  • Xerox of certificate obtained under coop act, 1861 or multi-state coop act-2002 in case of cooperatives
  • Form IX (not needed for proprietor)
  • Recall plan
  • Analysis report
  • NOC from municipal corporation or local authority
  • IEC document provided by DGET
  • List of the vehicle with the registered number (if the business has a transport facility)

PROCEDURE TO OBTAIN FSSAI REGISTRATION/LICENSE:

PROCEDURE TO OBTAIN FSSAI REGISTRATION LICENSE

Go to the official Fssai government portal and select the “Apply for a license/registration” option, you will then be redirected to a new page. Select the state. It then asks you to select the objective of the business. Select the correct description and click “Proceed”. 

It will display the selected details and the type of license you must obtain. If the details are correct, click on “Click here to apply for registration for all businesses”. A form will then appear, however, you must fill up your name, designation, type of business, address, contact details and other basic details and select “Save and Next”. 

Then upload the documents. Within seven working days, the status of your application can be updated and, if your application is accepted, your documents will be transferred to the scrutinise department. After this, the authorised department can conduct inspections (if necessary). 

After this, you will obtain a certificate of Fssai registration. You can download this certificate from the portal. It is mandatory to show the Fssai certificate during business hours.

Yes, the Fssai license is mandatory for all kinds of food-related businesses but small businesses need Fssai basic license. Obtaining a food license is a legal way to run your business.

The Fssai license is valid for one to five years after that you have to renew it without fail.
