FSSAI REGISTRATION

In Tamil there is a saying ‘Unave Marunthu’ which means Food is the best medicine. So to ensure the safety and quality of the food products, the Government of India had enacted the Food Safety and Standards Act, 2006. Every organization in the food supply chain  should maintain the safety standards and hygiene under the standards of FSSAI. 

FSSAI :

FSSAI stands for Food Safety and Standards Authority of India. FSSAI was regulated by the Ministry of Health and Family Welfare. It was an autonomous body. It maintains an important role in the promotion of the food quality. The idea of FSSAI was set up in 2008. For maintaining food hygiene and safety all over India. Later it came into force on 5th April 2011. The headquarters is located in New Delhi. It also has 6 Regional offices in Delhi, Mumbai, Guwahati, Cochin, Kolkata, and Chennai. The FSS Act which provides the guidelines for the food safety and hygiene terms. 

FSSAI REGISTRATION REQUIRED FOR ?

The FSSAI registration or license is compulsory for the person who is involved in the food business which includes Manufacturing, Distribution, Production, Storing, Processing, and Sale of food products. The FBO (Food Business Operators) necessarily have the FSSAI Registration or the License based on the business which was regulated by him.

For example, A person started a small hotel restaurant business, and he started to provide and serve chickens, while at the hotel, he provided the old chickens with fresh food, this act caused various food poisons and various food-contaminated diseases. Those acts should be prohibited by the law so the Ministry of Health and Family Welfare enacted the Food Safety and Standard Act 2006.

FSSAI REGISTRATION FOR FOOD BUSINESS :

The Food Business Operators, who are involved in selling food products in certain different categories of business shall require the FSSAI registration compulsorily. Those businesses are   

  1.  Retailers:
  2.  Petty shops, retail shops, snack shops, bakeries.
  3.  Stalls: Temporary stalls or permanent stalls, Tea stalls, South Indian food stalls, Chinese stalls,Vegetable vendors, Fruit stalls, and other stalls.
  4.  Dairy products: milk vendors, petty milk shops.
  5.  Oils: Vegetable oils and mills.
  6.  Hotels: Restaurants, Food catering, canteens, dhaba, Bar.
  7.  Refrigeration foods: Cool drinks, Energy drinks, and other juice items.
  8.  Online food suppliers 
  9.  Other suppliers: wholesale suppliers, marketers, distributors

TYPES OF FSSAI REGISTRATION :

The FSSAI Registrations are classified into three categories, based on the business type, the capacity of production, and the turnover of the food business.

  • Central License: It was granted to large food businesses.
  • State License: It was granted for the medium size food business
  • Basic Registration: For petty shops and small businesses it was granted.

ELIGIBILITY CRITERIA FOR FSSAI : (BASED ON TURNOVER )

  •  Basic Registration, the food business operators should have an annual turnover of about more than 12 lakhs. The applicant should fill out the Form A application for the basic FSSAI Registration.
  • For the FSSAI State licensing, the food business operators should have an annual turnover of about more than 12 lakhs and less than 20 crores, which should be applicable for the state licensing. The applicant should fill the Form B for obtaining the license.
  • For the FSSAI Central licensing, the food business operators should have an annual turnover of more than 20 crores. The applicant should fill the Form B for the central licensing.

ELIGIBILITY CRITERIA FOR FSSAI CRITERIA : (BASED ON BUSINESS AND PRODUCTION)

For the FSSAI basic Registration, The Food Business Operator who is involved in the small scale business which is covered under the basic FSSAI registration. Those categories of business are ;

  1. Turnover of not more than 12 lakhs per annum.
  2. Petty retailers, small-scale industries, and temporary stalls.
  3. Food-providing small-scale businesses and other snack shops etc.
  4. All the food products other than meats and milk up to 100 kg\ltr per day.
  5. Handlings and procurements and the transportation business there should be used for single vehicles.
  6. Meat shops should produce 50 birds, 10 small animals and 2 large animals for the business.

The following limit and the production of the business should be the eligibility for the basis of FSSAI licensing.

For the FSSAI State licensing, The food business operators who are involved in the medium-sized business should be applicable for this criteria.

  1. The annual turnover should be 12 lakhs to 20 crores if in the case of using transportation for the supply of the food products it must be 30 crores of limit.
  2. It includes food grains, cereals, and other products.
  3. The capacity that the food produces other than milk and meat should bring the limit of up to 1MT to 2MT per day (MT- MegaTon).
  4. For the milk and other businesses, it should be 501 to 50,000 liters per day as an average limit
  5. For the meat production, it should be 3-50 large animals, 11- 150 small animals, and 51-1000 poultry birds for the day involved in the production of the meat.
  6. For the transportation of the food products in the business there should be up to 100 vehicles.
  7. The storage capacity of food products is up to 10,000 MT.

For state licensing, it must be granted for a maximum of 5 years and a minimum of 1 year, based on the business and the production of the food products.

For the FSSAI State licensing, The food business operators who are involved in the medium-sized business should be applicable for this criteria.

  1. The annual turnover must be above 20 crores and in case the transportation is used for the business it should be around 30 crores.
  2. The size of the business should be larger, the following business should reach two to three states. The importation and exportation of the food products must be wider in space.
  3. The food-supplying business should be regulated by wider space to supply hotels, Restaurants, retail shops, and other stalls.
  4.  The mode of business should also be in the e-commerce and online modes.
  5. For the product limit of the food items except the milk and meat, it should be an average of more than 2MT per day.
  6. For the milk business, it should be the procurement of more than 50,000 liters per day.
  7. For the meat product, it involved more than 50 large animals, more than150 small animals, and more than 1000 poultry birds
  8. The storage capacity is around more than 10,000MT
  9. For transportation, there should be the use of more than 100 vehicles for the supply of food products.
  10. Should manage and regulate its own hotels and wider business levels. More than 100 vending machines should be in two or more states.

For central licensing, it must be granted for a maximum of 5 years and a minimum of 1 year, based on the business and the production of the food products.

FSSAI BASIC REGISTRATION :

For the FSSAI basic registration process, the applicant needs to fill out the FORM-A.

  • Photocopies for the business proof.
  • Aadhar and PAN ID.
  • Business certificate, partnership certificate or the incorporation certificate.
  • Partners ID proofs and other proof.
  • Proof of the business eg: bills, rental agreement, and NOC certificates.
  • Food safety system plan.
  • Supporting documents for the food business eg: health certificate and quality certificate for the food.
  • Bank account details and the statement for the past 1 year which is used in the business.

The process is simple, the person who comes under the eligibility criteria for the basic registration shall easily apply for the registration. In this process, the following details should be filled in the specified Form A, for the basic registration, the Aadhar and PAN verification is done, and we should fill out the nature of business. The following address proof and the identity of the business shall be disclosed and verified, For faster acceptance of the registration we should add the specific food test safety documents, and other relevant documents, once all the procedure is done we should get the reference number.

In the process of the registration, we should pay the fee amount of rupees 100 for basic registration of FSSAI. Within 7 days, the Food Authority should inspect the details provided and analyze the report. After the inquiry, we will receive the 14-digit FSSAI registration number within 30 days. If the application is rejected in certain cases, after 90 days we should provide the required details and reapply with the same procedure.

FSSAI STATE LICENSING REGISTRATION :

For the FSSAI State licensing, the applicant needs to fill out the FORM-B

Apart from the documents which was provided in the FSSAI basic registration 

  • The applicant should provide the health NOC certificate. 
  • Should submit the report of the food analysis test and water test which is used for the production of the food.
  • The COOP Act or the Multistate COOP Act provided certificates should be provided.
  • A list of the machinery used and the bill copy should be attached.
  • Lists of the partners and directors who are involved in business with their IDs.

For the FSSAI State licensing, we should pay the registration and licensing fee of about RS: 2,000 TO 5,000 based on the type of business. Once the application is filed we should get the Unique Application reference number. After 7 days of the inspection by the food authority, the State license should be granted within 60 days. 

ESSENTIAL DOCUMENTS FOR THE FSSAI CENTRAL LICENSING :

For the FSSAI Central licensing, the applicant needs to fill out the FORM-B.

Apart from the documents which were provided in the FSSAI basic registration. The applicant should provide certain necessary documents for the process of obtaining the FSSAI Central licensing. Those necessary documents are;

  • The applicant should submit the photocopies and identity of the business and the food products.
  • Should submit the analysis test report for the water quality and food quality report.
  • Should submit the raw materials used in the production of the food products.
  • Should submit the authority letter from the manufacturers and other responsible persons.
  • Should submit the health NOC which was approved by the municipalities or the state.
  • Should submit the declaration form and other supporting documents.
  • The certificate copy from the Ministry of Tourism.

Along with these documents the registration fee amount of RS: 7,5OO should be paid for the central licensing.  After filling out the form for registration with the provided documents, we can get the unique application number. Once the inspection is done by the authority, the central license should be provided within 60 days. In case of the rejection of the application after 90 days we need to apply for the fresh application and the necessary supporting documents should be attached.

Once the registration process or the licensing process is completed they should be notified the certificate of registration or the license copy should be sent to the mobile number of the mentioned mail id.

RENEWAL PROCESS OF FSSAI LICENSE :

The FSSAI license is very essential for the food business operators who are involved in the food process. The registration should be granted based on the business it may depend on. The license should be issued for either a minimum of 1 year or 5 years. The food operators should renew their licenses 30 days before the expiry.
